How Spanish Inheritance Tax Works

Spain's inheritance tax (Impuesto de Sucesiones y Donaciones) is charged on the beneficiary, not the estate. This is different from the UK system, where the estate pays inheritance tax before distribution. In Spain, each beneficiary is taxed individually on what they receive.

The tax is administered by the autonomous community (region) where the deceased was resident — or, for non-residents, the region where the property is located. Valencia (which covers the Costa Blanca) has its own rates and allowances that differ from other regions.

Who Pays and How Much?

The rate depends on two factors: the relationship between the deceased and the beneficiary, and the value of what is inherited. The national rate schedule runs from 7.65% to 34%, with a multiplier applied based on the beneficiary's existing wealth.

Key allowances under Valencia's regional rules:

The non-resident problem: Until a 2014 ECJ ruling forced equalisation, non-resident beneficiaries paid much higher inheritance tax than residents on the same inheritance. The rules have improved but the calculation remains complex — and the difference between resident and non-resident treatment can still be significant depending on circumstances.

The Six-Month Filing Deadline

This is where families get caught out. The inheritance tax return must be filed within six months of the date of death. There is an option to request a 6-month extension (before the deadline), but the interest on any tax due starts accruing from the original deadline regardless.

If a Spanish property is involved, the title cannot be transferred to the beneficiaries until the inheritance tax return has been filed and the tax paid (or an instalment arrangement agreed). This can create real practical problems for families who need to sell the property.

What Inheritance Tax Planning Can Achieve

The most effective planning tools available to expats in Spain include:

The Process After a Death in Spain

When someone dies owning property in Spain, the process involves:

This process is manageable — but it requires prompt action and experienced guidance. CNG Lawyers handles the full process on behalf of beneficiaries, typically under a power of attorney so that the family doesn't need to travel to Spain at an already difficult time.

How Much Does the Inheritance Process Cost?

Beyond the inheritance tax itself, the costs include notary fees, land registry fees, and legal fees for the acceptance of inheritance. These are typically modest relative to the value of the estate. We provide a full written estimate at the outset so there are no surprises.
